My landlord asked that we vacate the property by December when we asked for a reason they stated the kids did not have enough room to run around and play. Is that legal?

Kids are becoming a liability. Restaurants, malls, communities etc. don't want them around. It sounds that is the case with your kids, they are ticking other people off and your landlord would rather lose one tenant than 10.

It's August, so you have been given plenty of time. Unless your lease runs past the date you have been asked to leave, then he has the right to ask you to leave, and he has been very kind in giving you LOTS of notice. Obviously your kids are an issue for other tenants. You are not being evicted or kicked out, it just sounds like your lease is not going to be renewed.

Sounds as if your landlord is responding to complaints from other tenants.As long as the landlord has followed the terms on the tenancy agreement then there's nothing much you can do about this...it is legal.

The kids don't run at all, that is the reason they are stating. Their point is that they don't have enough room to play

This is a blatant violation of the Fair Housing Act. You are being discriminated against for having children, and "familial status" is a protected group.

laws for eviction are different from one state to the next. seems like a weak reason for kicking you out but you need to find out what the law says in your state.

Really sounds to me he has another agenda rather than this petty reason without further elaboration

If you are month to month tenants he can give you 30 days to move for any reason or no reason at all and you have no recourse.
