You say contract states life span of walls is 2 years and you have lived there much longer than that time.
Then you say it was your son's fault as he drew on the walls with crayons.
So now you are actually asking if you will HAVE TO PAINT THE WALLS?
So what do you think? If I were you I would paint the walls if I don't want to lose my security deposit.....duh......grow up and start behaving like an adult now.
Man up (or woman up). Your son did damage to the apt - all kids do this, by the way. Either repair the damage yourself or expect to be charged by the landlord. Just because you've been there longer than 2 years doesn't excuse the damage done to the walls. Many landlords don't repaint walls every two years, and if they did, the renters would probably complain about the mess every 24 months.
Paint is relatively cheap if you decide to handle it yourself. Go to a good hardware store where people actually know what they're doing (like Ace) or a dedicated paint store like Sherwin Williams. Tell the workers what you need to correct (crayon on the wall), follow their advice and buy the products from them.
It is YOUR fault that your son drew on the walls. Proper supervision of your child would of prevented this. And YES..you are legally responsible for new paint due to the actions of your child.
The life of the paint does not matter when you cause damage to it. YES you can be charged to repaint when you son draws on the walls.
Yes, you must paint the walls. Your kid defaced the walls. If you want to reduce expense, ask your landlord for the paint and do the painting yourself. At least you won't be paying the labor costs to do the repaint.
Yes. Tenant damage (crayon damage) is never considered standard wear and tear regardless how old the paint is.
