You need to read the rental rules for NH. There are usually strict rules regarding written notifications for damages. And items like normal cleaning and normal wear and tear are the responsibility of the tenant.

Just guessing, I don't think 14 months is past the statute of limitations, but check on that.

Make sure you at least attend the hearing. At the first one say you need to secure legal council and need to postpone the case. Say you don't have the money to properly represent yourself.

Maybe judge will suggest you two try to settle. Maybe you can make small monthly payments for some percent of what you owe.

I looked further into it. All the court can do is rule in favor of the landlord. As far as collecting any money goes, that's a different story. The only way he can actually get anything from me is if i have assets, which i don't. So even though he might feel as though he won, he really isn't winning anything. I'll show up to court though just for the entertainment. Thanks guys

I would countersue for your deposit. I'm pretty sure that every state requires landlords to provide an itemized list of why they are keeping your deposit, some even make the landlords pay you back double or triple the original amount as a penalty.

You do realize that once the LL gets a judgment against you, he will be watching you and will garnish your wages as soon as he is able? Also, judgments accrue interest and are renewable so that they never fall off your credit report.

You will never be able to buy a house until the judgment is satisfied and you will be paying higher interest rates on credit cards & loans as well as higher premiums for any insurance you purchase. Not only all of that, but you will most likely only be able to rent from slumlords whose properties are in the less-than-safe areas. No decent LL will rent to you since you have a proven track record of stealing another LL's income.

I moved out of my old apartment 14 months ago and i received a letter in the mail stating that my old landlord is trying to sue for back rent, damages and cleaning. Isn't there a statute of limitations for this? Keep in mind he never sent me an itemized list of damages done and repair costs, and never explained in writing where my security deposit went. I'm not worried about it anyway because you can't get blood from a stone. I don't have any assets. No bank accts no wages. But does he really even have a leg to stand on after this much time has passed? I live in NH if that helps anyone's answer
