Yes, the judge will evict them and then you go to small claims court and sue them. Your alternative is to let them live there. Start the eviction process and hope that the docket is clear.
First you didn't evict them. You decided not to renew their lease. That is NOT an eviction! They are using the poor me strategy. Be sure you follow the law. Tenants have access to lots of free legal advice. Know the law. Do you want to rent to them or do you want them out regardless? If so begin with a notice to quit [3 or 5 day depending on state laws]. Then file an unlawful detainer. You may find a para legal service that specializes in the paperwork but can't give you legal advice. There are law firms that specialize in landlord tenant law. Don't use an attorney off the street as it is a specialized body of law.Calculate the costs. Then think if this strategy is useful: Instead of paying a law firm $1000-3000 offer the tenants an incentive to move. DON"T give them money up front. Pay for the moving truck, transfer their deposit to a new landlord, try to negotiate a win win. Sure it ain't right, it may seem like extortion to you and me but keep your eye on the goal which is to get rid of troublesome people because the landlord tenant relationship is irreparably broken. So map out a plan, then re calibrate the relationship and see what it takes. Sound understanding. All this assumes they are low income or receiving assistance of some kind. If not you can modify your position a little since the legal process affects their credit [if you get a judgement and record it properly etc.] But why go through all this when you can create a win win. Then in the future learn landlord skills regarding selecting and screening tenants.
Unfortunately you have to go through the eviction process. I would sue them for the rent even while they are there and the judge gives them a date for eviction that is in the future. Try to get the judge to be sympathetic with your finances and set a short date for eviction at which point the marshall can remove them. Do you have a law there forcing tenants to get out for a relative who wants to move in? Maybe you can figure a way to get them out. I know it is illegal to lock them out and turn off the utilities but perhaps it is worth it if you only have to pay a fine. I think it is insane to allow tenants to stay in a place if landlord doesnt want them there. No property rights any more. It does not matter what season it is. Thats their problem.
If they have not paid rent on time, you only need to give them a 5-day notice to pay or get out, in Illinois, and file an eviction lawsuit on the 6th day. You would also want to immediately file a small claims lawsuit against everything they own.
Evictions for non payment are fast. Get a new lawyer. They will 100% be evicted and will be ordered to pay the rent.
If someone will get evicted, it will happen any time of year, judge does not refuse to evict in the winter.
There is no law about not evicting people in the winter.
It took a while for a neighbor of mine to be evicted. It took about that long, but a judge did evict her, she had three days to move ordered by the judge. She was told if she wasn't out then the sheriff's office would come in and make her get out. I would have loved to see that one! So yes the judge will evict if you do the eviction process correctly. I would start on it now.

Hi, I am a landlord in Chicago. So the lease is already ended.i have already gave them the 30 days notice last month, but they wouldn't move. I talked to them. I told them I would not renew the lease. If they are not moving out, they will be living in month to month basis. but then they said they wont pay the rent since i am evicting them. So i talk to the lawyer about getting an eviction. He told me if it's fast, it would be 2-3 months to get the tenants evicted. or it might take up to 6 months if it's slow. are you serious? then I will have to let the tenant live for 6 months for free? but then it will be December, winter time, i don't think the judge will then evict them. what can I do?
