land lord will not accept my notice since 3rd party on lease is not available to sign the notice. is there anything i can do to move?

There is no reason not to accept the notice. So long as it is signed by at least one tenant it IS legal notice. He may be worried about one leaving & 1 staying but it sounds like the other person has already left in which case the landlord is just being a jerk. Put it in writing that the other tenant has already moved out & mail it. If the other tenant has not moved out then the landlord still has no valid reason not to take the notice. If the other tenant fails to move out then they are still responsible to pay rent. If they don't pay they evict them. its not that hard.

Χαλαρ? is correct. It's not an agreement to terms like the lease is, it's a notice of intent. Think of it this way: You are providing notice that YOU will not be renewing the lease as it stands, because even if the others intend to renew, at least YOU will not be staying and the terms of the lease will have to be altered regardless. Send that certified letter, return receipt required.

If you're giving notice that you're not renewing a lease you don't need any signature other than your own. The contact is ending, and regardless of what your co-lessees intentions are, you're under no obligation to continue or enter into a new contract.
