Employer want to cancel my holiday?

Good evening everyone,

Im in bad situation with my employer.

I gave my notice by writing with 4 weeks notice.

Including 1 week of holidays I am taking on my last week of my notice.

My employer never mentioned or talk to me about me leaving, my notice, my final day and about my week holiday.

Untill today, 3 days before I leave the company and go on holiday. He say I cant go on holiday and must be cancel as he never agreed before. He say its no way I can take those holidays. He never said anything before about it verbaly or by writing.

I have explained him, Im going away, I have booked stuff and I can not cancel it whithout loosing money.

Employer handbook does not say anything about it a part i should give 4 weeks notice before taking holidays, but nothing on the side of employer about canceling. I guess they should give as much time than an employe.

What are the procedures now?

Should I do a grievance letter to my boss who told me I cant take holiday.

Should I go and see a solicitor or CAB?

Although you are under notice you are still employed and subject to the policies of the Company. From what you say your holiday was not officially sanctioned and you have made bookings solely on the presumption that it was ok. Officially the holiday was never on the cards so your employer has not 'cancelled' it.

Take proper advice if you wish but without documentation that the holiday has been approved before being 'cancelled' you have very little space for manoeuvre.

If you have outstanding holidays when you are working your notice either you have to take the holiday and leave early or your boss has to give you the holiday pay as part of your last paypacket. Check with ACAS

Contact the union that covers your work.

They like nothing more than getting involved with an evil employer,trying to make a decent living

I personally would take my holidays, you have given the correct notice period as per your contractual terms and are leaving the company anyway...little point in spending money on solicitors and CAB are only paid for benefits checks now and will refer you to other agencies... so go direct to ACAS and ask about the legality http://www.acas.org.uk/index.aspx?articl...

Phone the Pay and Rights helpline for advice. My view is that he owes you the holiday so you should just go. If he withholds pay then the above number can help you.

Go and see the C.A.B. The problem is that if you just go on holiday for the final week he may not pay you the salary he owes you

Your boss does not have to give his or her ok for your choice of holidays. He is perfectly correct and legal to refuse your choice of holidays.

Take your holiday. You are leaving anyway. I see no problem.
